Update II: Judge Marbley Sides With Secretary Of State In Provisional Ballot Case

U.S. District Judge Algenon L. Marbley sided with Secretary Of State Jennifer Brunner today by ruling  all of the roughly 1,000 challenged provisional ballots in Franklin County should be counted.

The planitiffs on behalf of the Steve Stivers campaign are planning an appeal to the 6th Circuit Court and the Judge said he will decide this evening whether to put his order on hold pending that appeal.

There are 27,306 provisional ballots remaining to be counted in Franklin County.

Union County released its final vote tally this afternoon, which added 86 votes to  Republican State Sen. Steve Stivers' lead in the race for the Ohio's 15th Congressional District

Steve Stivers now leads Mary Jo Kilroy by 479 in the race with nearly 300,000 votes counted.

In her race against Deborah Pryce in 2006 Kilroy picked up more than 2,000 votes in Franklin County when the approximately 20,000 provisional votes in the county that year were counted.

Update: Judge Marbley has issued an injunction on his order until next Friday.  This will give the Appeals Court time to weigh in if the Stivers supporters appeal his ruling.
