Did John McCain Commit Election Fraud Upon The State of Ohio?

On May 14, U.S. District Court Judge John D. Bates, a Bush Jr. appointee, ruled against the Democratic National Committee in its lawsuit against the Federal Election Commission.

The Democratic National Committee had filed the lawsuit on April 14, saying that the FEC (which has no quorum) will never be able to resolve the Democratic Party’s complaint that John McCain is violating federal campaign laws.

But the Judge said the law requires the federal courts to abstain from such lawsuits until the FEC has had the matter for 120 days. He said the fact that the FEC has no quorum is no excuse to disregard that law.

The FEC complaint was filed on February 25th. The 120 days for the FEC to act begins as of that date.

Breaking: Spakovsky Withdraws as FEC Nominee

After a five-month standoff, Hans von Spakovsky has withdrawn his name as a nominee to the FEC. The move likely clears the way for the deadlock over the FEC to be resolved.

Senator Harry Reid's response:

"I welcome the President's decision to withdraw the controversial nomination of Mr. von Spakovsky. It is an action I have repeatedly urged the President to take for more than six months. Democrats stood united in their opposition to von Spakovsky because of his long and well-documented history of working to suppress the rights of minorities and the elderly to vote. He was not qualified to hold any position of trust in our government.

"His withdrawal today is a victory for our electoral process. With Mr. von Spakovsky now removed, I anticipate that we will be able to swiftly put a functioning FEC in place. That too is what the American people deserve."

Once a quorum is created again at the FEC a ruling on Senator McCain's  potential campaign finance violations shouldn't be far behind.  Such a ruling could have an impact upon Senator McCain being able to utilize the public financing system in the general election.
