Shadows On High: The Husted "Exemption", Ex-Speaker Flaunts Ohio Residency Laws (Video)

For years, former State Senator Jeff Jacobson was subjected to embarrassing trips to his almost always empty home – but aside from a few news stories, Ohioans looked the other way.

State Senator Karen Gillmor and her late husband, U.S. Rep. Paul Gillmor, were the subject of a Fremont billboard in the late 1990s that read, “Karen and Paul Gillmor, if you lived in your districts, you’d be home by now.” (Unlike state legislators, federal legislators do not have district residency requirements.)

So former-Speaker/current-Senator Jon Husted’s decision not to live in his district, is not entirely new to Ohio (nor to his district, which previously elected “the Senator from Bexley” Jeff Jacobson.)

What is new, is Fox News, the New York Post, the Wall Street Journal and Ohio GOP Chairman-in-waiting Kevin DeWine creating a national media frenzy over Ohio’s residency laws by hounding thirteen college students who, while living in Ohio to register voters, registered to vote here.

ProgressOhio then challenged Franklin County Prosecutor Ron O’Brien, a Republican who stated the state’s residency laws were “crystal clear”, to apply said laws equally or not at all, by presenting evidence that out-of-state McCain campaign staffers had also registered in Ohio. No action or headlines followed – big surprise.

During this same time, the Dayton Daily News did a series of stories on then House Speaker Jon Husted’s seemingly empty Kettering home. When no hearings were forthcoming from the Montgomery County Board of Elections, ProgressOhio filed a complaint, requesting voter residency be applied equally, whether you are a college student or the Speaker of the House.

This week the Montgomery County Board of Elections called Husted in to testify and ProgressOhio was there – camera in hand.

Two things surprised us:

  • How often Sen. Husted’s statements under oath were at odds with the excellent reporting done on the issue.
  • The partisan appointed Montgomery County Board’s one-upsmanship, as to who was most non-partisan – while both sides called the only non-partisan group in the matter – ProgressOhio – partisan.

Is Jon Husted committing a fifth degree felony by violating Ohio’s residency laws?

We’ll let you judge for yourself.

As for ProgressOhio, we just want the law applied fairly, regardless of party or status. It’s the American way.

"WHAT'S GOOD FOR THE GOOSE IS GOOD FOR THE "GANDER".

John Husted needs to vote in the district where he lives. It makes no difference whether is a Republican, an independant or a Democrat. He needs to be stripped of his position in the Republican party, so that he doesn't feel the need to try to "cheat".

Clearly Husted is a dissembler if not a liar. Ohio law should be applied fairly and evenly to all, not exempting politically connected politicians. Why shouldn't such matters be decided by courts instead of partisan boards of election?

Senator John Husted should be held to the same standards (if not higher standards because of his elected position) than any other citizen.

Yes, election laws must be applied equally. No one should be above the law because this makes for an absurd situation. Unequal application of the law is just another way to justify unethical acts such as lying, cheating and stealing.

All parties have gotten away with this for years and it makes no difference whether it's federal or state. Let's be fair; working at the statehouse does involve lots of time and having a local address to stay (and not pay high rent) is a fair option. On the other hand, the law is what it is. Use it wisely and apply with fairness. Don't go looking for little problems when the larger ones are being neglected. Now that the Democrats are in control of the state, I still don't see any effort made towards economic development and helping small and new businesses. It's still padding the pocketbooks of the party in power by the larger corporations. Consider the increase in power rates across that state of a failed deregulation plan. Ohio Edison for example; pay me for the costs of deregulation and pay me again for the cost of regulation...

GET REAL?! I know folks residing in Franklin County who were threatened with the felony charge unless they withdrew their ballots prior to November 4, 2008. Ron Obrien coerced US citizens to withdraw their ballots based on HIS "crystal clear" interpretation of the law. Why are elected officials not held to this same standard?

Jon Husted should be treated no differently than anyone else, including myself. If I were to vote in another county other than where I live, I would be prosecuted. All the hype that is and/or has been mentioned with the out-of-state voters and nothing being done to Jon Husted is wrong. So my question is simply why is Joh Husted treated differently than those students or myself, if I were to have vote out of my area. The law is the law and it needs to apply to everyone, not just for certain individuals.

Jon Husted is guilty by what I viewed on the video and he needs to be prosecuted.

Unlike Bush's assertion, no one is above the law. This is not a monarchy or a dictator ship where the leader rules supreme. This is a democracy where the leaders are of the people and consequentially subject to the same laws as the people.

I live in late congressman Paul Gillmor's district, and he lived in Dublin. He took such flack about not living here that he eventually bought a place in the district (Tiffin). He used to say he was a resident of Old Fort (his father's residence). He got away with it for years. Now his widow is our state senator, and she claims Tiffin as her home.

I would like to know where she actually lives.

Expecting a professional politician to be truthful is like expecting your brother to get pregnant and give birth all on his own. Never works.

There is no viable definition of politician that does include the caveat that you will be lied to in any discussion.
