Recent research by Ohio Election Justice Campaign reveals over 800 pages of documents on destruction of 2004 ballots in violation of court order not submitted to the court, contrary to quoted comments in minutes of meeting of Ohio Secretary of State Jennifer Brunner with numerous election officials and voting rights leaders. These records are evidence in a federal lawsuit. OEJC calls upon all patriots to commemorate our great nation's independence from King George's tyranny, including his denial of elections, to demand election justice in Ohio and across the nation.

A recent review of court records revealed that the over 800 pages documenting the destruction of the ballots in violation of federal court order were not in the possession of the court.
Over 56 of Ohio's 88 counties destroyed election records.
On July 3, the following letter was sent in response to this startling discovery:
Dear Secretary Brunner,
I am writing to bring a serious issue to your attention.
According to the Voting Rights Institute meeting minutes from August 21, 2007, your understanding was that every county sent an inventory and a letter of explanation to Columbus with the ballots and that "this information was all turned over to Judge Marbley. We have had no updates from his court as of today." Page 6, Voting Rights Institute, Advisory Council Meeting, August 21, 2007, Shaker Heights, Ohio; http://www.sos.state.oh.us/vri.aspx.
Our research has revealed that these records have not been filed with the Court, although almost a year has passed.
In addition, 15 counties have yet to submit letters of explanation.
Please bring this issue to the attention of your staff charged with this responsibility or to the Ohio Attorney General as soon as possible.
I know that many members of Ohio's voting rights leadership, including representatives from the League of Women Voters, the NAACP, People for the American Way, and Citizens' Alliance for Secure Elections, as well as members of the group I direct, not to mention numerous election officials, serve on the Voting Rights Institute Advisory Council.
They and many others were under the impression that the Court had possession of these critical documents and were waiting for the Court to do something.
Are Ohio voters dumb hayseeds or have they trusted unwisely?

Below I have provided an article that documents lots of Ohio voters whose votes were not counted, because their ballots were too big to close the flap, so they didn't close the flap. The article also reports on the very small number of paper ballots used on election day.
Things to note: Ohio Secretary of State Jennifer Brunner made paper ballots available for our March 4th Primary Election in 2008. It should be noted that the poll workers were forbidden to tell people they could vote on paper. Those ballots were only for people that knew to ask for them, and almost no one knew to ask. Secretary Brunner got an award this week from the Kennedy Center. Maybe this is why she looked so sad and glum during her speech. Her award was for paper ballots. Too bad the poll workers couldn't tell the voters they could use those paper ballots.
Hocking County Election Whistleblower (2004) Sherole Eaton reported to me the problem with absentee ballots not fitting in the envelope provided by the Hocking County Board of Elections. The below article does not mention Hocking County. All Ohio's 88 counties need asked about this. Do I have any volunteers that could do this and get the data to me? How many counties is the Secretary of State aware that the envelopes didn't fit the ballots? Who printed this junk, Barrett Brothers, Dayton Legal Blank, or someone else? Who ultimately is responsible for thousands of Ohioans, or will it be hundreds of thousands not having their votes counted. How many were effected state-wide?
Did this happen in other states? Please let me know of such states. The whole country needs monitored for this for November. The states yet to vote in the primary need monitored in advance.
I'm again amazed that these people get paid for their work, and this is the best they can do. Time for another round of the "Dumb Ass Awards".

Lucas County Elections Board tries to address ballot problem

Lucas County elections officials are investigating ways to avoid a repeat of
what happened in the March 4 primary election, when 921 absentee ballots
were disqualified because voters failed to seal them in ballot envelopes
that were too small.

We'll get their take on the exit polling process there, complete with their serendipitous path-crossing with Richard Hayes Phillips whose book, "Witness to a Crime", is now published and available to purchase (regarding how the Presidential election was stolen in Ohio in 2004; Richard was also twice a guest on VoteRescue Radio).
In our second hour we'll have an fascinating interview with Jim March, Black Box Voting Board member, accomplished election technology buff, and valiant Election Integrity activist.
Jim and Arizona EI activist John Brakey were involved in a December 2007 court challenge in Pima County, Arizona on behalf of the Pima County Democratic Party, against Pima County election officials for the release of the Diebold (GEMS tabulator) databases containing voting data from the 2006 election (and those from all future elections), on the presumption that they should be public records. There is a belief that these databases could show fraud or other malfeasance by county election officials. The county maintained, of course, that releasing such information would make tampering in future elections easier, even though those same county officials and insiders have all the means and opportunity to manipulate elections.
We'll also talk with Jim about his arrest in July of 2005 for trying to observe the Diebold central tabulator as the votes were being counted in San Diego's mayoral election.
Other news we'll cover will include the April 18th non-hearing at the Ballot Law Commission in New Hampshire for Albert Howard's Petition for Appeal of the recent New Hampshire primary recount; the continued effort of evidence-gathering from that recount on the part of Bev Harris and citizen videographers and activists, and more information and analysis about the results of the Pennsylvania primary.

Black Box Voting is currently doing proof of concept testing on our "Theory of a crime" and will release details next week on how it's done, so that preventive measures can be put in before November. Now, it wouldn't be the first time I have been accused of being a "conspiracy theorist" but that sure sounds like a conspiracy. Of course the chorus of Brunner's critiics mentioned in the dispatch article of March 13, Absentee Avalanche, who claim "the results show that people are comfortable with machines" don't have all the FACTS and, obviously neither did the voters who came to the polls in last Tuesday's primary who were not made aware of their options. For a better understanding of the Dispatch article below... a little history has been provided on several of these Ohio characters, and the voting machine integrity in Summit County.
Ohio State Senator Kevin Coughlin, who is pointing out problems with Alex Arshinkoff, has some issues of his own. Kevin was very involved in Ohio's voter suppression bill, officially titled House Bill 3. It seems as though Kevin's job was to trump up the charges of Voter Fraud in his testimony before the Ohio Senate Rules Committee, when Ohio's problem is not that, but alleged Election Fraud by vendors, technicians, and election officials.
Coughlin's testimony seems to have been successful as House Bill 3 adopted the voter ID provisions which currently disenfranchise hundreds, or hundreds of thousands of Ohioans. When you can't vote, or are forced to vote provisionally anywhere in Ohio because of the new voter ID rules, thank State Senator Kevin Coughlin (you might want to drop him a card, or call him).

As for Arshinkoff and Summit Counties elections: In 2006 Alex Arshinkoff was a board member for the Summit County Board Of Elections. That November Summit County had reported that over 100% of the people voted in 34 precincts for November.
Bryan Williams, the director of the BOE blames it on the ES&S machines counting some of the ballots twice, because the ballots are two pages. Yet some absentee's got counted only once. He said it was a software problem. I must let my gentle readers know that in Ohio the Secretary of State, Jennifer Brunner is now in March of 2008 looking at spending 64 million dollars, up from 31 million dollars in December 2007 on more ES&S machines to tabulate our votes. I presented Kathy Spinelli, of The Ohio Secretary of State's office in the spring of 2007 with the undervote/overvote report from Summit County, and the following results which I have provided for you, and so much more that was in that report. These make the post-it-note stickers in New Hampshire look like an armored truck in the way of security.
Folks, why would they make security so lame... "The Dumbass Excuse" applies here. Too stupid to actually seal the box. I must ask, where are the responsible adults?
I seem to remember video of New Hampshire's Assistant Secretary of State, David Scanlan being asked (I think this was compliments of Susan Pynchon), "Who ordered the stickers?" "Who is responsible?" Time for a repeat of that line of questioning here in Ohio. Scanlan did not have a decent answer. Video on this New Hampshire scene will be available at blackboxvoting.org when it is ready.
The GOP site here asks why the ballots were driven with a person of one party. I don't know if they changed requirements specially for this afternoon pick up, but in Ohio, the ballots always go with one person, of one party. This is determined by which party won the most votes in the Gubernatorial Primary. Winner gets to have the precinct judge position, and drive the ballots for the next four years. It makes sense that a truck load would have more than one party represented in who does the transportation of the ballots. Unless they only picked up Democratic Precincts, this seems like a problem. Yet I believe the law is written that the precinct judge drives them. Cleveland does vote heavily Democratic. I would like to know who the photographer was of these pictures.

OEJC Announces Quarantine That Machine Initiative
During its Election Education Forum in Dayton, Ohio this month, the Ohio Election Justice Campaign unveiled its citizen action initiative, Quarantine That Machine, for use during Ohio's primary election this Tuesday, March 4, 2008. Developed by an Ohio pollworker for use by other pollworkers and voters, Quarantine That Machine is a simple-to-follow initiative.
As explained by Paddy Shaffer, Director of the OEJC, "If the voting machine you use behaves in an illegal manner, it should be treated as part of a crime scene. The theft of your vote is a crime by the voting machine and its vendors against YOU.
Treat it as such." Voters are also encouraged to report problems through the new mobile blogging community, Utterz. With utterz, voters can blog the machine problems immediately from their cell phone with audio, video, images, and text. Utterz provides a phone number for people to call in and "speak" a blog entry, which appears as an audio file. Voters are asked to tag their entry "Ohio Voter Mugging 2008" and to identify the scene of the crime.

As outlined by Ms. Shaffer, voters should watch for the following problems when voting on the touch screen machines:
1. Vote Hopping - This is when you vote for a candidate or an issue, and your vote visually hops and goes to another candidate or issue on the screen. We are generally told it is a calibration problem. For the voter, this means your vote is not recorded for who or what you intended. You have been robbed.
2. Paper Tape Does Not Match Your Vote - Please take the time to read the paper tape when you vote. The paper tape should correspond exactly with your vote on the touch-screen machines. This paper tape is called the Voter Verified Paper Trail (VVPT). In Ohio, the VVPT is your official ballot for an audit or recount.
Note: If you wear glasses, bring them as the paper tapes are hard to read. The typeface is small, and some tapes are printed very light.
