COLUMBUS, Ohio) — Ohio Attorney General Richard Cordray announced that a New York Federal District Court has issued an important ruling that will allow a major lawsuit to proceed against Bank of America, Merrill Lynch and various individual officers and directors.

U.S. District Court Judge P. Kevin Castel substantially denied the defendants' motions to dismiss the case. The ruling clears the way for Ohio's pension funds and allied pension systems to move forward with their claims that the defendants committed securities fraud and issued false proxy statements. If successful, the lawsuit could potentially recover billions of dollars for shareholders.

The lawsuit alleges that Bank of America, during merger negotiations, agreed to allow Merrill Lynch to pay up to $5.8 billion in accelerated year-end bonuses to its executives and employees, but failed to disclose that information to shareholders before they voted to approve the merger.

Additionally, in the two months before shareholders voted on the merger, Merrill Lynch suffered billions of dollars in losses. The complaint alleges that senior executives at both Merrill Lynch and Bank of America were aware of these massive losses but did not disclose the information to investors prior to the shareholder vote on the merger.

"The court's ruling is a major win not only for Ohio teachers, public employees and all Bank of America shareholders, but it also is a win for shareholders of every company and for our financial system," Cordray said. "The court ruled that companies cannot pick and choose what they will tell their shareholders. Companies will not be allowed to hide exorbitant bonuses and huge losses from their shareholders. Ohio AFL-CIO President Joe Rugola will crisscross Ohio this Labor Day weekend for a three-day "Keep Ohio Moving Forward" Tour. The tour will celebrate the contributions of Ohio's working families and highlight the need to continue to move forward with candidates that support working families. "Ohioans face a choice to return to the failed Wall Street policies that created the economic disaster facing Ohio or to continue to move forward with candidates who will fight for workers in Ohio," says Rugola.  "We need candidates, like Governor Ted Strickland and Lee Fisher, who understand Ohio values and will continue to work to create jobs and build a positive economic future for our state."

The tour will include stops at Labor Day events in Portsmouth on September 4, Lorain on September 5, and Barberton on September 6 Labor Day.  Rugola will speak at all three events and will be joined by labor-endorsed candidate Governor Ted Strickland and AFL-CIO President Richard Trumka at the Lorain event.

DOVER, OH – After Bob Gibbs broke federal law by accepting illegal campaign contributions from one of his campaign staffers, the Federal Elections Commission (FEC) has now uncovered 15 additional instances in which Gibbs is in violation of federal law.  The 16 separate instances in which Gibbs took illegal contributions add up to a total of $50,467.01 – all of which must now be refunded, per FEC rules.

“Bob Gibbs is showing that he’ll do anything – even break federal law – to prop up his desperate campaign,” said Andrew Ricci, spokesman for Zack Space.  “Gibbs’ blatant disregard for other peoples’ money is absolutely shameful.  After raising taxes on every single Ohioan, Gibbs used taxpayer dollars to pay his campaign’s expenses, and now we’re learning that his campaign is being mismanaged and is in clear violation of federal law.”

“The acceptance of excessive contributions is a serious problem,” reads the letter from Chris Jones, Senior Campaign Finance Analyst for the Federal Elections Commission.

Under current federal campaign finance law, individuals are allowed to contribute up to $2,400 to a given candidate for each election.   In two separate letters (attached) dated August 24, 2010, the FEC outlined 16 different instances in which Bob Gibbs accepted “excessive and/or prohibited Contributions,” dating as far back as August 21, 2009.

The Gibbs campaign had 60 days – all of which have now passed – to reattribute or redesignate the contribution.  After the initial 60 days, amounts in excess of the allowed limits must be refunded, according to federal guidelines and the attached letters from the FEC.  If the Gibbs campaign has not already taken action on these 16 violations, nearly ¼ of their cash on hand was contributed illegally and must be returned.  The FEC has given them until September 28 to comply, though further enforcement action by the Commission – including hefty fines – is possible.

 

With the end of combat operations in Iraq days ahead, the President salutes our troops for their service and pledges to fulfill America’s commitment to them as veterans.  90,000 troops have left Iraq since the President came into office, and by the end of next year even the troops taking part in the non-combat mission will be home.  

The administration is upholding the sacred trust with our veterans by building a 21st century VA, making it easier for veterans with PTSD to receive the benefits they need, funding and implementing a Post-9/11 GI Bill, and devoting new resources to job training and placement to help those veterans looking for work in a tough economy.

WARREN, Ohio — A convicted former congressman from Ohio has won more time to prove he collected enough petition signatures to run for Congress Nov. 2 as an independent.

Ohio Secretary of State Jennifer Brunner broke a Trumbull County elections board tie Wednesday, giving James Traficant, a chance to prove that he collected enough signatures. Brunner stepped in after the board deadlocked on whether to disqualify him from the ballot earlier this month.

Brunner, a Democrat, plans to order election boards in Akron and Youngstown to cooperate in setting the stage for determining if Traficant has enough signatures.

Former Traficant aide Linda Kovachik says his backers welcome the chance to correct errors in judging the validity of petitions.

Traficant represented the Youngstown area as a Democrat for nearly two decades before being convicted of corruption in 2002. Traficant is attempting to get his name on the November ballot.  If he's successful, he will face incumbent Democrat Tim Ryan and Republican Jim Graham for the 17th District Congressinal seat.

It's not difficult to see why Maryellen won this hard-fought endorsement. Just look at how she describes the grassroots campaign she's running:

“Once again, Congressman Kasich proves that he prefers election-year gimmicks to substantive policy proposals. Last week, he proposed a plan to outsource the state's economic development activities to Wall Street, and now he's recycling an initiative already undertaken by Governor Strickland.

“Governor Strickland has helped grow our economy from the bottom-up by doing the things Congressman Kasich only talks about, like eliminating and revising more than 2,000 rules and regulations and increasing access to capital so that small businesses can grow and create jobs here in Ohio. Given Congressman Kasich's long history of outsourcing jobs and supporting policies that benefit Wall Street and the very wealthy at the expense of Ohioans, we can't afford to turn Ohio over to him."
The Democrats' stimulus raised economic growth by as much as 4.5 percent in the last quarter and may have increased the number of people with jobs by more than 3 million, according to a Congressional Budget Office (CBO) report released Tuesday.

The CBO report also provided a new estimate of the stimulus' 10-year cost — $814 billion, down slightly from its $862 billion estimate from earlier this year but slightly higher than the initial $787 billion projection from early 2009.

The report gives a boost to President Obama and Democrats, who pushed the stimulus through Congress with minimal support from Republicans in February 2009. The White House and Democratic leaders have argued that the stimulus was necessary to prevent the economy from slumping into an even deeper recession and possibly a depression after the financial crisis.

Tuesday's CBO report found that the stimulus package cut the jobless rate by between 1.4 million and 3.3 million and increased the number of people employed by between 1.4 million and 3.3 million last quarter. The stimulus also increased gross domestic product somewhere between 1.7 percent and 4.5 percent for that period.
A proposal by the John Kasich for Governor camp to privatize the Department of Development would lead to backdoor dealings and open up state government to the kinds of cronyism and corruption Ohio’s state government has not seen in years, say OCSEA leaders.

The plan would outsource hundreds of jobs at the Department to a private entity run by a 12-member board of business leaders appointed by Kasich. This plan "would lead to backdoor dealings and open up state government to the kinds of cronyism and corruption Ohio's state government has not seen in years," says OCSEA. OCSEA represents some of the workers at the department.

The GOP candidate for governor said at a press event that he does not want “civil service restrictions” or “public employees” to get in the way of privatizing the agency that hands out millions of dollars in grants and incentives to promote local businesses.

“Privatizing the Department of Development would be just another deal aimed at giving political payback to Kasich supporters,” said OCSEA President Eddie L. Parks. “This would lead to the sort of Tom Noe cronyism whereby a private citizen has the ability to use public funds for their own private purpose.”

Attorney General Richard Cordray Announces Candidacy for Re-election

(COLUMBUS, Ohio) – Ohio Attorney General Richard Cordray, joined by 16 other state attorneys general, is calling on the craigslist online classified advertising service to immediately take down the Adult Services portion of the site. Cordray's action is due to continued prostitution advertisements and concern about reported sex trafficking of children through the Adult Services section of the craigslist website.

The multi-state letter, to craigslist CEO Jim Buckmaster and founder Craig Newmark, contends that craigslist cannot – or will not – adequately screen these illicit ads, so it must stop accepting them altogether and shut down the Adult Services section.

"The increasingly sharp public criticism of craigslist's Adult Services section reflects a growing recognition that ads for prostitution – including ads trafficking children – are rampant on it," Cordray said. "In our view, the company should take immediate action to end the misery for the women and children who may be exploited and victimized by these ads."

"Your much-touted 'manual review' of Adult Services ads has failed to yield any discernable reduction in obvious solicitations," the letter says. "We recognize that craigslist may lose the considerable revenue generated by the Adult Services ads," the attorneys general said. "No amount of money can justify the scourge of illegal prostitution, and the suffering of the woman and children who will continue to be victimized, in the market and trafficking provided by craigslist."

Even following its 2008 public pledge to attorneys general and the public that it would better police its own site, craigslist remains a hot spot for blatant prostitution ads.   Read More »

This morning US House Representative John Boehner gave a speech in Cleveland where he offered an economic agenda for our country. But he was really sketchy on providing any details, and that's not much of a plan. It's a good thing we know 5 actions Congress can take on taxes that will help create jobs and strengthen the economy.

  1. Allow the 2001 and 2003 tax breaks for the wealthiest Americans to expire this year as scheduled. Inefficient tax loopholes and preferences for those earning more than $250,000 a year should be closed.
  2. Ward off billions in new tax cuts for the very rich by maintaining a strong federal estate tax. There should also be a surtax on very large estates, such as those valued at more than $20 million.
  3. Eliminate tax loopholes for big corporations and the very wealthy, and hold Wall Street accountable. Prevent offshore maneuvering by multi-national corporations to avoid taxes. Curb wasteful subsidies for oil and gas companies.
  4. Ensure economic security for working families. Extend improvements in the Child Tax Credit, Earned Income Tax Credit, and American Opportunity Tax Credit for college so millions of low- and moderate-income working families do not lose tax credits at the same time other middle class tax cuts are extended.
  5. Stop ineffective and wasteful tax cuts. Making further cuts in taxes without paying for them is not responsible; it worsens the federal deficit and jeopardizes economic growth over the long run. It benefits the wealthy or corporations and takes money that could be used to assist struggling families and communities, invest in critical national priorities, or reduce the deficit.

Call John Boehner now. Tell him to invest in our country's future by supporting this 5 point plan for fair and responsible taxes that will help create jobs and revive our county's economy.

This morning, House Republican Leader John Boehner outlined his ‘economic plan’ at the City Club of Cleveland—which would return us to the same failed policies of the Bush Administration. Mr. Boehner endorsed proposals to privatize and cut Social Security, cut taxes for the wealthiest Americans, protect corporations that ship American jobs overseas, and dismissed regulations that protect consumers and workers.

Today, House Republican Leader John Boehner did the public a favor by revealing the Republican plan to return to the failed Bush economic policies that produced a deep recession, record deficits, a loss of 8 million jobs and an unprecedented financial crisis. America must continue to move forward in a New Direction, not back to the ‘exact same agenda’ of the Bush years.

Mr. Boehner reiterated the Republican leadership’s opposition to additional regulation of our food supplies – at the very time American consumers face risks of food safety in eggs and meat. Republicans also opposed protecting consumers against the unfair practices of oil companies, insurance companies and Wall Street financial institutions.

Democrats will not allow the scare tactics and empty rhetoric of Leader Boehner and his Republican colleagues to go unanswered. We must keep moving America forward, not back to failed Bush economic policies, which is all Mr. Boehner proposed this morning.

State has already weatherized nearly 15,000 homes under Recovery Act   

Washington, DC – U.S. Energy Secretary Steven Chu announced today that Ohio has been selected to receive $1.5 million to expand the state’s successful weatherization program. Ohio has been one of the country’s weatherization leaders under the Recovery Act and is continuing to accelerate the pace of weatherization in the state.  In total, Ohio has already weatherized nearly 15,000 homes under the Recovery Act, which is almost half of their total targeted homes.

Ohio’s efforts are contributing to the success of the program nationwide.  After ramping up last year, the Weatherization Assistance Program is now weatherizing homes at its optimal rate – approximately 25,000 homes per month.  In June, states reported that nearly 31,800 homes were weatherized with Recovery Act funding – the most ever in a month.  This summer alone, more than 80,000 homes will be weatherized across the country.  A state-by-state breakdown of homes weatherized in the second quarter of 2010 is available HERE.

“The weatherization program is successfully delivering energy and cost savings for American families while helping to rebuild our economy,” said Secretary Chu.  “These investments in energy efficiency under the Recovery Act are putting thousands of people to work in Ohio and across the country as part of our clean energy future.”

People Working Cooperatively, based in Cincinnati, has been selected to receive $1.5 million to establish a comprehensive energy conservation program that will integrate delivery of weatherization and housing rehabilitation services through utility programs and an existing network of 5,000 volunteers.  The project will provide weatherization services to approximately 675 low-income households in Indiana and the Duke Energy service area in Ohio drawing on volunteer labor.  Smart meters will be installed as well as a photovoltaic solar system on a multi-family building.  The project will also develop a real-time evaluation system to improve the cost-effectiveness and delivery of weatherization services.   The award selection was part of nearly $120 million in awards announced nationally to complement and expand existing weatherization programs, drive innovation in the program, and deliver even greater energy bill savings for local families.  More information about the awards is available HERE.

The weatherization program is also creating thousands of jobs locally – putting carpenters, electricians, and factory workers back to work installing insulation, upgrading appliances, and improving heating and cooling systems.  According to state reports, the Recovery Act Weatherization Assistance Program supported more than 13,000 jobs in the second quarter of 2010, including nearly 1,400 jobs in Ohio.

The U.S. Department of Energy’s Weatherization Assistance Program helps low-income families save energy and money by improving the energy efficiency of their homes.  According to a recent study by Oak Ridge National Laboratory, weatherization services save families an average of more than $400 in energy costs during the first year after home retrofits are installed.

WASHINGTON D.C. - U.S. Sen. Sherrod Brown (D-OH) today applauded Ohio's inclusion in the federal "Race to the Top" program.  The program, administered by the U.S. Department of Education, awards Recovery Act funds to schools that measurably improve their quality of education. 

"By including Ohio in the Race to the Top program, the U.S. Department of Education is providing a mark of confidence to the hardworking teachers, school administrators, and parents who work day in and day out to make Ohio schools some of the best in the country," said Brown. "These critical Recovery Act funds will not only improve our education system for today's students, but lay the groundwork to provide a world-class education to future Ohioans. I applaud Governor Strickland and his administration-in addition to Superintendent Deb Delisle and the State Board of Education-for putting together a strong application for the program and working tirelessly to improve our state's schools."

More than 530 Ohio school districts signed on to the state's application for funding.  In January, Brown wrote to U.S. Department of Education Secretary Arne Duncan urging that Ohio's application be given strong consideration.

"Ohio has commenced its new biennium with a comprehensive education reform plan," Brown wrote. "Funding provided through the Race to the Top program would accelerate the state's existing agenda to strategically address gaps in delivering a highly effective learning experience to all students."  The same month, Ohio's education system was rated the fifth-best in the nation by Education Week, the state's highest rating yet from the publication.

Governor Ted Strickland and State Superintendent of Public Instruction Deborah Delisle today announced that the U.S. Department of Education has selected Ohio as one of the winning states to be funded in Round 2 of the Race to the Top program. Ohio will receive $400 million in Race to the Top funds during the next four years.

"I want to thank Secretary Duncan and the Obama administration for this opportunity to implement what I believe is a visionary education plan for Ohio's children. Our students deserve every opportunity to succeed in and beyond the classroom, and I believe the creative and forward-thinking initiatives outlined in our winning application provide just that," Strickland said. "Ohio has shown its commitment to encouraging innovation by passing successful economic development initiatives like Ohio Third Frontier, and this award builds on our job creation strategy by helping prepare the next generation of Ohio entrepreneurs and innovators."

"I give my heartfelt thanks and appreciation to our education and community partners who supported this application, and our dedicated team of education leaders who worked tirelessly on behalf of Ohio's children," Strickland said.

The Round 2 Race to the Top application was submitted by the Ohio Department of Education in June. In total, more than 538 Local Education Agencies, representing more than 60 percent, or about 1 million, of Ohio's school children, agreed to participate directly in Ohio's Race to the Top activities. Ohio was selected as a finalist in late July and a team from Ohio made a presentation and answered questions from U.S. Department of Education reviewers earlier this month.

BearA 24 year old died last week outside Cleveland. This time the culprit wasn't a car accident or a gunshot - it was a 400 pound, privately-owned bear. According to the 911 tape, in less than 10 seconds the bear had mauled the young man, inflicting fatal wounds.

The bear owner kept dozens of other dangerous, wild pets on his property including tigers, wolves and a lion. He's been convicted in federal court for his animal trafficking and had to be barred from forcing bears to wrestle humans.

If you want to end this abusive treatment of animals, tell the farm board to live up to their promise to make animals and people safer across Ohio.

For over twenty years, regulators have been unwilling or unable to shut down this operation, which is inhumane for animals and lethal for humans.

Gov. Ted Strickland is working to put an end to lethal, renegade operations like this. We need to make sure the Ohio Livestock Care Standards Board is held accountable and lives up to this promise and others at their meeting this week.

Columbus, Ohio--Ohio Governor Ted Strickland, Ohio Attorney General Richard Cordray, Ohio Treasurer Kevin Boyce and Ohio Department of Veterans Services Director Bill Hartnett today launched the Ohio Veterans Bonus program in Columbus.

An estimated 200,000 Ohio residents are eligible for the Ohio Veterans Bonus.

"In November, the voters of Ohio resoundingly supported Issue 1," Strickland said. "Ohioans wanted to extend a small measure of our thanks and offer a tangible sign of our profound respect for our veterans of recent conflicts and their survivors. Today we are asking all eligible veterans and their survivors to apply for this special payment from the state."

"Of course no payment is adequate reward for the sacrifices made on our behalf," Strickland added.  "But these checks will help make a mortgage payment, or put food on the table, or start a savings account. And what's more, these payments will say something clearly and directly to our veterans: thank you."

All Ohio veterans could be eligible for a bonus if they served on active duty with U.S. armed forces, including the Ohio National Guard, anywhere in the world during specified periods of time.  The active duty must be for purposes other than training.  Applicants must have been legal residents of Ohio when they went on active duty and also must be Ohio residents when they apply for a bonus.

"The process of providing these bonuses began a few years ago in Iraq, when an Ohioan serving as an Army captain there wrote to my office on behalf of the servicemen and women in his unit," said Cordray. "Working together, Ohioans responded in a big way, bringing these bonuses to fruition. It truly is a story of democracy at its finest. My office will continue to work to support our Veterans through the application process, to make it as simple as possible."
 
The estimated processing time for bonus applications is approximately eight weeks, depending on the volume of applications initially received.
