Yesterday, Ohio Sheriff Richard K. Jones appeared in federal court facing charges that he violated the constitutional rights of an undocumented immigrant. The plaintiff, Luis Rodriguez, claims that Jones infringed on his 4th and 14th amendment rights. Cincinnati’s Local 12 channel reports:

[Officials [police] said they were at the site to talk to a supervisor about undocumented workers, but while there Rodriguez and others were interrogated and asked to provide identification, said Rodriguez’s attorney, Al Gerhardstein. Gerhardstein said his client, who had lived in Butler County for 11 years, was arrested and charged with providing a false identification and was deported to Mexico, though he was later acquitted of the charge.

Rodriguez is seeking damages and also trying to establish the principle that there aren’t any exceptions to the Fourth or 14th amendments.

Jones is co-chair of Republican Senate candidate Rob Portman’s law enforcement coalition.

“Rob Portman understands that we are a nation of laws and that fighting crime requires efforts at all levels of government,” Jones said. “I am proud to support his campaign for U.S. Senate.”

Hannity concert closed to most media

Tickets are pretty much sold out for the Sean Hannity Freedom Concert at Kings Island tonight.

At 2 p.m., less than 100 seats -- all with obstructed views -- were left at the 10,000-seat Timberwolf Amphitheatre, said Kings Island spokesman Don Helbig.

The concert lineup includes Billy Ray Cyrus, Charlie Daniels, Lee Greenwood and Michael W. Smith performing at 7 p.m.

Hannity himself, plus other political guests, also are expected to speak . However, most media outlets -- except Fox News -- have been excluded from covering the event by Hannity's organizers, Helbig said.

The sixth annual concert series benefits the Freedom Alliance Scholarship Fund started by Oliver North to help dependents of deceased or disabled U.S. military veterans. North will attend the show.

On Friday, a first-ever for the White House was held, a Spanish language town hall meeting to listen to the Hispanic community's concerns and inform the public about the government’s efforts to control the impact of the H1N1 virus. The town hall featured Administration officials including Secretary of Labor Hilda Solis, and an audience of 130 or so folks including health care workers, community activists, and concerned citizens, and was moderated by Univision Anchor Edna Schmidt, whose network partnered up with us on this important event.

No one ever died of a maryjane overdose, but on the U.S.-Mexican border there's a brutal gang war over this plant material which has resulted in the deaths of hundreds of people.

Marijuana -- or marihuana as the state legislators say, which only goes to show how backward and outdated our public policy is on this issue -- does not kill. The underground market for weed and accompanying greed, however, does.

Let's put an end to these needless gun battles by legalizing pot. It's supply-side economics: if pot is no longer rare, vicious gangs are out of business.

Collecting billions of dollars in sales tax revenue to fund, say, cop recruits and bridge repairs is just a little ol' side benefit of legalizing weed.

Time to plant the seeds of hope that this violence will end.

 

I remember reading some years ago that George Washington, although a Virginian, often thought about moving back to the Ohio frontier because of his fond memories of working here as a surveyor in his youth.

Now, in the New York Times Book Review (Feb. 4), it's claimed that Charles Darwin also once thought of becoming a Buckeye.

"Darwin visited Tierra del Fuego, Tahiti and Tasmania, along with other exotic locales, but he never set foot in the United States," writes reviewer Christopher Benfey in his appraisal of two new Darwin histories.  "Around 1850, charmed by popular tales of lush countryside and the exciting adventures of the Underground Railroad, and still withholding from public view his explosive theory of evolution, he flirted briefly with the idea of moving his large family, with seven children under the age of 11 and another on the way, to Ohio.  The middle states, he wrote, are "what I fancy most."

A quick Google check does indeed turn up this Darwin letter containing that "what I fancy most" quote, although at least here Darwin doesn't specify Ohio as the middle state he had in mind.

But let's assume Benfey did more research on this than I care to contribute, and that "Beautiful Ohio" was in fact one of Darwin's dream destinations.  (It appears, however, that it was far from the only one.)

In any case, I don't want to destroy the delicious irony that Darwin, who in recent decades has stirred up so much debate in Ohio classrooms, once thought of moving here with his own brood.

Of course in the end, both Washington and Darwin stayed put and Ohio had to muddle along instead with its spawn of famous politicians, sports stars, movie actors and astronauts.

But still, it's nice to be the object of great mens' dreams.  So a big O-H-I-O to Darwin on the occasion of his 200th birthday (Feb. 12).

I had posted earlier today that Vic Wulsin (D) won the U.S. House of Representatives for the 2nd District. That post was an error. At least, she won Hamilton County.

The National Journal's WakeUp Call (sub. link) reports today that Ken Blackwell has thrown his hat into the ring for RNC Chair.

Before this farce goes any further, I'd like a statement from Mr. Blackwell on this lovely, pre-packaged burning cross, that his friends at the American Family Association (AFA) are peddling:

What does Blackwell have to do with the AFA?

  • Blackwell gladly accepted an endorsement from the AFA during his 06 race for governor.
  • Blackwell was selected to join the Arlington Group "a powerhouse, by-invitation-only organization whose roughly 60 members have direct access to the White House", which was started by AFA founder Don Wildmon.
  • Blackwell is a member of an ultra-secretive, extremist group with Wildmon ties - the Council for National Policy. In fact, Blackwell actually paid his membership dues out of his 2006 campaign funds.
  • Blackwell has also done campaign events (video) with people with hate-group hanger-on Larry Pratt.
Why not give the AFA the full benefit of the doubt?
  • The burning cross has gained such notoriety, that as of today a Google search for 'American Family Association' produces 18.7 million hits. Number five is the burning cross. The AFA are certainly aware of this issue and have not removed the item from their site, even though the item's noteriety is based on the disbelief that a "family" group would sell something that so clearly is a symbol of hate.
  • They are based in Tupelo, Mississippi. This former Confederate town of 35,000 has played host to a KKK rally (video) as recently as last October and have a history that goes back much farther.
  • Wildmon made his name taking offense and taking names over things that offend him.
  • They have been an outspoken opponent of other minority groups. His most recent faux-outrage was a 5 month boycott of McDonald's organized because a Canadian executive of theirs was on the board of the National Gay and Lesbian Chamber of Commerce.
If this is truly just a Christmas cross, then Ken Blackwell shouldn't have a problem putting one in front of the RNC or the Buckeye Institute. And if he finds it unseemly, then maybe he should call his friends at the AFA and have it removed.

Columbus has had a wonderful African American leader in Michael Coleman. Most recently, our mayor has refused a pay raise for himself as well as 400 other city employees in preparation for a tight city budget. He did the same in 2003 as City Council President. It's a small gesture, but a meaningful one.

Apart from his politics, Mayor Coleman seems like an all-around good guy. He's been in the C-bus public eye for a long time, and I've been impressed with him as a husband and father. He's a handsome man too -- he reminds me of Billy Dee Williams, especially in his Lando Calrissian persona, and not so much as the Colt 45 pitchman.

Mayor Coleman fits right in marching in the St. Patrick's Day parade. Like President-Elect Obama, he's a black man we Caucasians can trust -- oh, I didn't mean to infer that black men are untrustworthy, um...this is why it's best not to discuss race issues if you're white. But since I am gleefully unemployed and don't have to worry about getting fired, I shall continue to blather....

I was touched by the tears of joy and expressions of "I never thought I'd live to see the day..." from people of color in the aftermath of Obama's election. I'm sure I have never fully appreciated their struggle.

Just as a thought experiment, I tried to imagine Hillary Clinton being elected. Would women be jumping for joy in the streets for their first woman president? No. The young girls I know have no doubts that they could grow up to be president. You really can't compare gender to race.

African Americans -- and it is cool that Obama is a genuine African American -- have certainly made great strides and we whites are happy for them. However, while we readily accept blacks in the public sphere, we lack personal relationships with them. Personally, my immediate neighborhood has exactly one black family in it, and I no longer have contact with the black people I used to work and occasionally lunch with.

My lack of black friends makes me feel a bit guilty. On the other hand, I haven't made any new white friends in the last 20 years either -- no discrimination there.

I cringe when I think of racist remarks my parents used to say, and it's unfortunate that those rare negative memories have stuck with me. But lately I've been self-aware of my own prejudices against Hispanics. Why do Spanish-speaking workers in my neighborhood annoy me so much? Could it be that I don't understand Spanish? I have obsessive thoughts about their immigration status.

My neighborhood is about 10% Asian American -- their immigration status never crosses my mind. These are super-studious people who dress their children nicely and walk them to school. Asians -- a really broad, catchall ethnicity -- are great neighbors in my stereotype portfolio.

One of my favorite websites in Stuff White People Like. It's so funny. It has spawned Stuff Asian People Like and other knockoffs. SWPL is funny because it's so true for me -- I love New Balance shoes (#96)!

I voted for Obama and I support Mayor Coleman, but not because they are black. It's just an added bonus.

 

These laws function as eachothers' handmaidens. It's clear to me that any elected government official and or public servant who possibly finds these vile "handmaidens" functions objectionable, is facing multiple court action. I'm concerned that if certain partisan political groups and their lobbies don't have their way, the result could be martial law. Note the date of the required compliance -
December 31, 2009. Can't imagine what the hurry is...

STATES RECEIVE FINAL FEDERAL RULES TO SECURE DRIVER LICENSES
NATIONWIDE THROUGH REAL ID INITIATIVE
COLUMBUS - The U.S. Department of Homeland Security (DHS) announced today final rules establishing
minimum security standards for state-issued driver licenses and identification cards.
Earlier today, Ohio Department of Public Safety and Ohio Bureau of Motor Vehicles officials received the
284-page final rule document and participated in a national conference call where DHS officials discussed
today's announcement.
"Our review of the proposed final guidelines for Real ID implementation is underway," said Henry Guzmán,
Director of the Ohio Department of Public Safety. "Throughout this evolving process, our primary concerns on
a state level have always been the financial impact of implementing this new federal standard in license
verification and issuance, and determining how REAL ID impacts how we serve our customers across the
state."
DHS officials confirmed during today's conference call Ohio was the first state to be granted an extension to
comply with the provisions of the REAL ID act. In collaboration with the General Assembly, state officials
initiated the request for an extension to federal officials in October and received notification from DHS officials
granting an extension on December 10.
The first deadline for compliance with REAL ID is December 31, 2009. By that date, states must complete an
initial upgrade of the security of their license systems.
REAL ID addresses document fraud by setting specific requirements that states must adopt for compliance,
including (1) information and security features that must be incorporated into each card; (2) proof of the identity
and U.S. citizenship or legal status of an applicant; (3) verification of the source documents provided by an
applicant; and (4) security standards for the office that issue licenses and identification cards.
ODPS officials will work closely with the Governor's Office and federal officials throughout the review process,
Guzmán added.

While Barack Obama has struggled to capture the Jewish vote, it turns out that one of his wife's cousins is the country's most prominent black rabbi - a fact that has gone largely unnoticed.

Michelle Obama, wife of the Democratic presidential nominee, and Rabbi Capers Funnye, spiritual leader of a mostly black synagogue on Chicago's South Side, are first cousins once removed. Funnye's mother, Verdelle Robinson Funnye (born Verdelle Robinson) and Michelle Obama's paternal grandfather, Frasier Robinson Jr., were brother and sister.

Funnye (pronounced fuh-NAY) is chief rabbi at the Beth Shalom B'nai Zaken Ethiopian Hebrew Congregation in southwest Chicago. He is well-known in Jewish circles for acting as a bridge between mainstream Jewry and the much smaller, and largely separate, world of black Jewish congregations, sometimes known as black Hebrews or Israelites. He has often urged the larger Jewish community to be more accepting of Jews who are not white.

Funnye's famous relative gives an unexpected twist to the much-analyzed relationship between Barack Obama and Jews in this presidential campaign. On the one hand, Jewish political organizers, voters and donors played an essential role in Obama's rise to power in Chicago, including some of the city's wealthiest and most prominent families. But the Illinois senator has struggled to overcome suspicions in some parts of the Jewish community, including skepticism about his stance on Israel and discredited but persistent rumors that he is secretly a Muslim.

Funnye, who described himself as an independent, said he has not been involved with the Obama campaign but that he has donated money and was cheering it on.

"I know that her grandfather and her father and my mom and all of our relatives that are now deceased would be so very, very proud of both of them," Funnye told the Forward.

Michelle Obama and the Obama campaign did not respond to requests for comment.

Funnye told the Forward that he has known Michelle Obama (born Michelle Robinson) all her life. His mother and her father, Frasier Robinson III, enjoyed a close relationship, and Funnye said he saw Michelle several times a year when they were growing up, mostly at family functions and on occasional visits to her house.

"Her father was like the glue of our family," Funnye said. "He always wanted to keep the family very connected and to stay in touch with each other."

Funnye, 56, said he and Michelle, 44, were not especially close growing up, but he remembers her as "energetic and smart and very caring."
The two fell out of touch when they grew older and went their separate ways but then reconnected years later when Michelle Obama was working for the University of Chicago and Funnye was leading a local social service organization called Blue Gargoyle. Funnye also worked with Barack Obama, then a state senator, who came and spoke at events for the organization. When Barack and Michelle Obama married, Funnye and his family attended the wedding.

Although Funnye's congregation describes itself as Ethiopian Hebrew, it is not connected to the Ethiopian Jews, commonly called Beta Israel, who have immigrated to Israel en masse in recent decades. It is also separate from the Black Hebrews in Dimona, Israel, and the Hebrew Israelite black supremacist group whose incendiary street harangues have become familiar spectacles in a number of American cities.

Funnye converted to Judaism and was ordained as a rabbi under the supervision of black Israelite rabbis, then went through another conversion supervised by Orthodox and Conservative rabbis. He serves on the Chicago Board of Rabbis.

Funnye's relationship with the Obama family was reported in the Chicago Jewish News in an article dated August 22. A Wall Street Journal article in April reported that the aspiring first lady had a cousin (whom the paper mistakenly referred to as a second cousin) who is a prominent black rabbi but did not mention Funnye by name.

The rabbi's familial connection with the Democratic presidential nominee is also a matter of common knowledge in Funnye's synagogue.

"He really jumped on everyone's radar after the 2004 convention," Funnye said. "That's when some people said, 'Isn't he related to you or something?' I said, 'Yeah, he's married to my cousin, and she's making him everything that he is.'"

In the Opinion Page of today's Wall Street Journal Rush Limbaugh claims an Obama radio ad is using "incomplete, out-of-context lines from two radio parodies."

His amazing exculpatory evidence? It's all parody! Just like when he referred to Obama as "the little black man-child."

The first sound bite was extracted from a 1993 humorous monologue poking fun at the arguments against the North American Free Trade Agreement. Here's the context:

"If you are unskilled and uneducated, your job is going south. Skilled workers, educated people are going to do fine 'cause those are the kinds of jobs Nafta is going to create. If we are going to start rewarding no skills and stupid people, I'm serious, let the unskilled jobs that take absolutely no knowledge whatsoever to do -- let stupid and unskilled Mexicans do that work."

And the other one?

I took the restrictions Mexico imposes on immigrants and appropriated them as my own suggestions for a new immigration law.

Here's the context for that sound bite: "And another thing: You don't have the right to protest. You're allowed no demonstrations, no foreign flag waving, no political organizing, no bad-mouthing our president or his policies. You're a foreigner: shut your mouth or get out! And if you come here illegally, you're going to jail."

Notice the final sentence, which indicates that even "foreigners" who are here legally should shut their mouths or leave.  Not to worry, that's all part of the parody too.

FDIC Report Suggests Banks can Offer Alternatives to Payday Loans at a Profit

The Federal Deposit Insurance Corporation will soon be releasing a report that suggests that banks can provide consumers with affordable small loans and still make a profit. The "Small-Dollar Loan Pilot Program," includes 31 FDIC selected banks from all across the United States, and is intended to demonstrate that banks can offer small loans to consumers at reasonable rates. The pilot program included banks with pre-existing programs and banks with newly developed programs. According to the report about the pilot program, "Eighty percent of small-dollar pilot program banks offer interest rates of 18 percent or less."

Many of the parameters set in the pilot program are similar to those included in Ohio's House Bill 545. These parameters include: annual percent rates below 36% APR, low or no origination fees, no prepayment penalties, access to financial education, and extended prepayment periods.

First quarter reporting by the banks in the pilot program suggests that banks are able to offer alternative products to payday loans and other high-cost products and still make a profit. Initial reports from a majority of the banks in the program also suggest that customers utilizing their small-loan products transition to more tradition loan products after complying with the terms of the small-loan agreement.

"Although the Small-Dollar Loan Pilot Program is still in its initial stages, participating banks are already demonstrating innovative strategies in areas such as advertising and linked savings that may prove to be replicable for other banks. Banks in the pilot are well within the 36 percent maximum APR established in the FDIC's Small-Dollar Loan Guidelines, and five banks thus far have reported using the small-dollar product as a cornerstone for profitable relationship."

This is a positive development and bodes well for Ohio. Much has been made of the 28% interest rate cap on payday loans in our state and it's potential impact on the industry. The U.S. Congress, at the behest of the Pentagon, sought to cap interest rates on payday loans at 36% APR, seeking to mitigate the negative impact payday lending was having on troop readiness and moral. Alternatives to payday loans do exist in the form of small loans offered by credit unions, banks and other more traditional lenders. Given that several of the banks are being profitable or are seeing no negative impact on their profit margins from the development of small-loan programs and that a majority of customers are avoiding a cycle of debt and entering into more traditional loan products, there is little question that this is a model that should be replicated in Ohio and across the United States.
Our relations with Mexico and Border Security

While it would be ideal to erase borders between countries, that would be impractical without reciprocity between nations. We seek that reciprocity as a practical goal. While we recognize that there must be some controls on immigration, if only for the sake of national security, the Green Party would endorse a friendlier (less intimidating) attitude towards immigration in all nations within certain guidelines.
The Green Party must consider immigration issues from an international standpoint, taking into account international labor and environmental standards, and human rights.

1. Preferential quotas based on race, class, and ideology should be abandoned for immigration policies that promote fairness, non-discrimination and family reunification.

2. I support policies that reflect our constitutional guarantees of freedoms of speech, association, and travel.

3. Particular attention should be given to those minorities who are political exiles and refugees.

4. Our relationship with our neighbor to the south, Mexico, needs to be given added attention due to the special historical and cultural relation it has with the southwest portion of the United States. Our border relations and reciprocal economic opportunities should be a central concern of a government that is looking to improved economic, environmental, and social conditions for both peoples.

5. The Green Party calls for permanent border passes to all citizens of Mexico and Canada whose identity can be traced and verified. Work permits for citizens of Mexico and Canada must be easily obtainable, thereby decriminalizing the act of gainful employment. This action would help eliminate exploitation of undocumented persons by criminals engaged in human contraband (coyotes) and unethical employers. It would also help ensure that taxes will be paid in each corresponding nation per its laws. These measures will also help temporary residents from Mexico and Canada to secure driving privileges and liability insurance.

6. Labor laws must be adjusted to take into account seasonal foreign workers. Employers must provide full rights to wages and health benefits to immigrant workers who make voluntary contributions to pension plans and pay Social Security taxes.

7. I advocate an end to employer sanctions, which have been shown to hurt not only undocumented workers but also U.S.-born workers (especially those of color). A fair and equitable legalization program will provide equal access to working people of all nationalities, not tied to a specific employer or guest worker program. Programs involving temporary worker status must include the option of permanent residency for immigrants already in the U.S. and protection of migrant worker savings.

8. Greens oppose "English-only" legislation. I would advocate legislation to ensure that federal funds marked for communities to provide ESL (english as second language) training, and health and social support services to immigrants actually go to them. When funds are spent in other areas, immigrants are being deprived of benefits that they earn as productive workers in their communities.

9. I oppose the use of racial profiling. I am concerned about reports of illegal raids and traffic stops based on ethnic appearance and not probable cause of a traffic violation. I would further advocate funding or education programs designed to reduce racism and bias against ethnic minorities.

10. I advocate adoption of certification standards for translators.

11. I oppose those who seek to divide us for political gain by raising ethnic and racial hatreds, and by blaming immigrants for social and economic problems.

Payday Lenders Continue to Spend & Spin

The payday lobby seems to think that their opponents are being bankrolled by "special interests," apparently disregarding the fact that they are one big "special interest." In Arizona, the payday lenders have exceeded the $9 million mark in their efforts to overturn a pro-consumer bill in that state.

In Ohio, the payday lobby is outspending their opponents by incredible margins. The disparity in expenditures is easily evident just by looking at the millions of dollars spent on television ads by the payday lobby versus the unusual technique being utilized by the proponents of payday lending reform: YouTube.com! ANAHEIM, California (AP) -- Cinderella, Snow White, Tinkerbell and other fictional fixtures of modern-day childhood were handcuffed, frisked and loaded into police vans Thursday at the culmination of a labor protest that brought a touch of reality to the Happiest Place on Earth.


"Tinkerbell" and other Disney characters were handcuffed Thursday in a protest outside the gates of Disneyland.

The arrest of the 32 protesters, many of whom wore costumes representing famous Disney characters, came at the end of an hour-long march to Disneyland's gates from one of three Disney-owned hotels at the center of a labor dispute.

Those who were arrested sat in a circle on a busy intersection outside the park holding hands until they were placed in plastic handcuffs and led to two police vans while hundreds of hotel workers cheered and chanted.

The protesters were arrested on a misdemeanor count of failure to obey a police officer and two traffic infractions, said Sgt. Rick Martinez of the Anaheim police. They were cited and released, Sgt. Chris Schneider said.

Bewildered tourists in Disney T-shirts and caps, some pushing strollers, filed past the commotion and gawked at the costumed picketers getting hauled away. The protest shut down a major thoroughfare outside Disneyland and California Adventure for nearly an hour.

"It's changing my opinion of Disneyland," said tourist Amanda Kosato, who was visiting from north of Melbourne, Australia. "Taking away entitlements stinks."

The dispute involves about 2,300 maids, bell hops, cooks and dishwashers at three Disney-owned hotels: the Paradise Pier, the Grand Californian and the Disneyland Hotel.

The workers' contract expired in February and their union says Disney's latest proposal makes health care unaffordable for hundreds of employees and creates an unfair two-tier wage system. The union also says Disney wants to create a new category of part-time employees who would receive greatly reduced benefits.

"The other hotels around the area all have health care that is provided by the boss and have been able to get wage increases," said Ada Briceno, president of Unite Here Local 681, which represents the workers.

"At the other hotels in the same classification, for the same work, the workers get paid $2 to $3 an hour more."

Disney spokeswoman Lisa Haines said Disney and the union are in negotiations and nothing has been finalized. She said workers have protested 14 times but sat down to negotiate only 11 times in the past six months.

"Clearly we're disappointed that Unite Here Local 681 has spent more time protesting," she said. "Publicity stunts are not productive and are extremely disruptive to the resort district."

Before the arrests, the picketers marched and chanted outside Paradise Pier, holding signs that read, "Disney is unfaithful," and "Mickey, shame on you." They were joined by community activists and religious leaders from local churches.

Luz Vasquez, who works in the bakery at Disneyland Hotel, said she can't afford to lose many of her benefits. She said it's already hard to care for her three grandchildren and aging mother while earning $14.32 an hour.

"Disneyland is being unfair with us because we're fighting for our health care and they're trying to take it away," said Vasquez, 45. "They're trying to cut our hours and take away our seniority."

Co-worker Diane Dominguez, 50, said she was worried about losing health care because of the heavy labor involved in lifting mattresses, moving furniture and making dozens of beds a day. She also said rising prices and the cost of gas were eating into her salary of $11.11 an hour.

"The most important is health care. We need that and they want to take it away," she said.

At the heart of the issue is a free health care plan that has been provided to Disney hotel workers through a trust fund that Disney and other unionized hotels in the area pay into.

Briceno said that in exchange for the free medical plan, union members agreed in previous contracts to a lower wage for hotel workers in the first three years of their employment.

But Disney now wants to eliminate the free health plan for new hires and wants to create a new class of workers who put in less than 30 hours a week, said Briceno. Those part-time workers would receive no sick or vacation pay and not be given holidays, she said.

The company also wants to increase the number of hours full-time employees must work before qualifying for the health plan, she said.

"At the end of the day what it means is that workers are going to be priced out of health care," she said.

Haines said the majority of other employees at Disneyland pay for a share of their health plan, even though the resort shoulders about 75 percent of the overall cost. She said it's important to negotiate a contract that's fair to those other unions, too.

"We do remain hopeful that we can reach an agreement that's both fair and equitable, providing that union leadership is reasonable and realistic in its approach," Haines said.
Industry Front Group Website Goes Live

The Community Financial Services Association's campaign to overturn House Bill 545 went live with a new website yesterday. Their website, Ohioans4financialfreedom, displays how out of touch they are with real Ohioans.

First, they say: "Protect 6,000 good-paying jobs that could be lost."

This is not accurate. House Bill 545 says absolutely nothing about closing any businesses or preventing the dispersion of payday loans. House Bill 545 simply caps interest rates and fees at 28% APR, protecting Ohio's consumers from predatory 391% APR interest. Payday lending stores have already started applying for licenses to continue operating under the new law from the Ohio Department of Commerce. If any stores close, it's because they choose to, not because they have to.

Second, they say: "Protect your financial freedom and private financial choices."

Payday lenders target low-income neighborhoods where it is easier for them to encourage people to walk through the door. Neon signs with "Get cash in minutes!" and "Easy cash quick," etc. Once a borrower is trapped in a cycle of payday loans, it becomes necessary for the consumer to keep taking out loans. This is not a choice! Usurious payday loans at 391% are bad for Ohioans and bad for the Ohio economy. Usury is not freedom!

Third, they say: "Protect your right to privacy about your personal finances."

This is a nice catch phrase that appeals to just about everyone! House Bill 545 includes a provision calling for the creation of a database that will let lenders know how many loans a person has taken out at a given time. This allows lenders to lend according to borrowers ability to repay - something neither predatory mortgage lenders nor payday lenders seem to care about.

And finally, once again, the industry uses their lame argument for why their referendum should be on the ballot: "Ohioans have a right to repeal bad laws."

Well, it bears repeating that House Bill 545 is one of the best consumer protection laws in the country and will help hundreds of thousands of Ohioans escape the debt trap. Ohioans do have a right to overturn bad laws, but this referendum effort is not being mounted by Ohioans, but by industry lobbyists and attorneys flown in on their corporate jets. Where are the citizens working on this referendum? Where are the consumers calling for 391% interest? They are nowhere to be found. Instead, the industry lobby CFSA is the sole donor to the effort to repeal House Bill 545. This is right in line with what they are doing in other states like Arizona where they've spent $8.7 million to overturn a consumer law and in Virginia where they succeeded in buying higher interest rates for a low, low price of $20 million.

The Ohio government should be PROTECTING consumers from predatory business practices that rely on borrowers getting trapped in a cycle of debt! Payday lending is bad for Ohio!

NEW AMERICANS TELL THEIR STORIES

The voices - and experiences - of Columbus' new ethnic residents will be heard on Wednesday, July 9, during the New Americans Forum to acquaint officeholders and candidates with the concerns of recent immigrants.

The event, at 6:30 p.m. at the IBEW Local 683 Union Hall, 23 W. 2nd Ave., will bring together members of Columbus' Hispanic and Somali communities with some two-dozen candidates for federal, state and local office.

Since the 1400's, immigrants have come to America to find their dreams or to escape treachery, war and starvation. They have not always been greeted warmly or well.

Columbus, for the most part, has been a welcoming community. Still, many newcomers experience lengthy bureaucratic delays in qualifying for citizenship. They also have to navigate their way through unfamiliar institutions, such as the schools, the courts and local permit and licensing agencies.

And in an election year, new Americans - like all citizens - can get confused by constantly changing voting requirements and procedures.

At the same time, politicians today face many opposing opinions as to how to address immigration and immigrants in the post 9/11 era.

The new Americans are courted by politicians "but there's not much awareness there," said one Somali community leader. "And after the election, they don't come back."

The New Americans Forum is being sponsored by the Central Ohio Coalition of Democratic and Progressive Organizations to encourage dialogue between officeholders, candidates and new ethnic residents. Following panel discussions, a representative of the Ohio Secretary of State's office will clarify voting procedures and information will be shared about the Ohio Democratic Party's Neighborhood Leader Program.

The Coalition is a coordinating group for more than 20 Democratic and independent clubs and PACs in Franklin, Licking, Delaware and Perry counties.

I need to say at this point I am definitely NOT open to conversation addressing the relative merits of this law and rationalizations of why this law is okay. It is not okay. The following is "off the table for me":

1. If people really want the info, they'll get it.

2. Anybody can just print it off from the web.

3. Nobody reads these things.

4. Our taxes shouldn't be used to pay for this.

5. Single mothers/fathers and married mothers/fathers on welfare know everything there is to know about benefits. They can just as easily get this information if they cared.

I've been hearing the above opinions frequently in many different contexts. The above 5 statements have been made by normal middle class individuals who lead genuinely self - sacrificing lives to help others.

Obviously, I'm not an attorney. I wish for a magical filing of an emergency temporary (effective AT THE VERY LEAST until all formal results of the November 2008 Presidential Election are made public) injunction in a Federal District Court to shut this withholding of the paper copy of the 2008 Ohio Voter Information Guide DOWN.
