On Tuesday September 2, 2008 at 2:00 p.m. the Morgan County Board of Elections will hold a hearing at the Morgan County Courthouse at 19 East Main Street, McConnelsville, Ohio 43756-1172. This hearing will be the second hearing for an issue the Morgan County Board of Elections (BOE) already ruled on in January of 2008. Mike Tigner is requesting that this hearing be cancelled, and that the BOE cannot change their earlier decision to deny Prosecutor Richard Welch the ability to cast a vote in Morgan County for the 2008 Primary Election, as Welch resides in a different county, Washington County. Welch is a Colonel in the US Army and has been away from the county for parts of the last several years. The same BOE officials later accepted the vote cast by Welch. The issues are far larger than just this vote…

Paddy Shaffer is an amazing election integrity activist who,

Kenneth Blackwell before her) accountable to the citizens on a number of
critical election fraud issues there for years. She has been one of the
primary leaders in Ohio attempting to eliminate the use of electronic voting
machines there. Among her many actions, Paddy was in New Hampshire helping
Bev Harris and others monitor the Recount of the Republican
Primary this past January; in 2006; is a frequent contributor to OpEd News.
Paddy also served as Robert Fitrakis's campaign manager in
2006 during his bid in the Ohio governor's
race.

Virginia Brooks is a member of the Ohio Election Justice Campaign, and
another of the eight Pro Se Litigants seeking to intervene in the Federal

Judge Algenon Marbley to begin criminal contempt proceedings for the destruction of ballots from the November 2004 election.

A recent review of court records revealed that the over 800 pages documenting the destruction of the ballots in violation of federal court order were not in the possession of the court.

Over 56 of Ohio's 88 counties destroyed election records.

On July 3, the following letter was sent in response to this startling discovery:

Dear Secretary Brunner,

I am writing to bring a serious issue to your attention.

According to the Voting Rights Institute meeting minutes from August 21, 2007, your understanding was that every county sent an inventory and a letter of explanation to Columbus with the ballots and that "this information was all turned over to Judge Marbley. Our research has revealed that these records have not been filed with the Court, although almost a year has passed.

In addition, 15 counties have yet to submit letters of explanation.

Please bring this issue to the attention of your staff charged with this responsibility or to the Ohio Attorney General as soon as possible.

I know that many members of Ohio's voting rights leadership, including representatives from the League of Women Voters, the NAACP, People for the American Way, and Citizens' Alliance for Secure Elections, as well as members of the group I direct, not to mention numerous election officials, serve on the Voting Rights Institute Advisory Council.

They and many others were under the impression that the Court had possession of these critical documents and were waiting for the Court to do something.

Are Ohio voters dumb hayseeds or have they trusted unwisely?

Below I have provided an article that documents lots of Ohio voters whose votes were not counted, because their ballots were too big to close the flap, so they didn't close the flap. The article also reports on the very small number of paper ballots used on election day.

Things to note: Ohio Secretary of State Jennifer Brunner made paper ballots available for our March 4th Primary Election in 2008. It should be noted that the poll workers were forbidden to tell people they could vote on paper. Those ballots were only for people that knew to ask for them, and almost no one knew to ask. Secretary Brunner got an award this week from the Kennedy Center. Maybe this is why she looked so sad and glum during her speech. Her award was for paper ballots. Too bad the poll workers couldn't tell the voters they could use those paper ballots.

Hocking County Election Whistleblower (2004) Sherole Eaton reported to me the problem with absentee ballots not fitting in the envelope provided by the Hocking County Board of Elections. The below article does not mention Hocking County. All Ohio's 88 counties need asked about this. Do I have any volunteers that could do this and get the data to me? How many counties is the Secretary of State aware that the envelopes didn't fit the ballots? Who printed this junk, Barrett Brothers, Dayton Legal Blank, or someone else? Who ultimately is responsible for thousands of Ohioans, or will it be hundreds of thousands not having their votes counted. How many were effected state-wide?

Did this happen in other states? Please let me know of such states. The whole country needs monitored for this for November. The states yet to vote in the primary need monitored in advance.

I'm again amazed that these people get paid for their work, and this is the best they can do. Time for another round of the "Dumb Ass Awards".

Elections Assistance Commission (EAC) oversees the secretive election systems used in the United States. It has announced the appointment of Ms. Alice P. Miller as its Chief Operating Officer (COO).

In 2003, the Washington DC Office of the Inspector General's (OIG) wrote a report

of an investigation into the unethical behavior of, among others, Ms. Alice P. Miller, Executive Director of the DC Board of Elections and Ethics. It states that Ms. Miller colluded with others to, in effect, unilaterally grant herself and a colleague $12,000 raises, and that she drafted fraudulent memos to do so.

Lucas County Elections Board tries to address ballot problem

Lucas County elections officials are investigating ways to avoid a repeat of
what happened in the March 4 primary election, when 921 absentee ballots
were disqualified because voters failed to seal them in ballot envelopes
that were too small.

Daniel Pilrose, county elections director, said larger ballot envelopes are
being ordered for the Nov. 4 election, and he said more explicit directions
printed on the back of the envelope might help reduce the number of
disqualified votes.

This Sunday, April 27th, from 2-4pm CDT, VoteRescue Radio is happy to welcome back our wonderful returning guests Marj Creech and Paddy Shaffer, both valiant election activists from Ohio, who traveled to Pennsylvania to help conduct exit polls there for their primary election last Tuesday, April 22nd. We'll get their take on the exit polling process there, complete with their serendipitous path-crossing with Richard Hayes Phillips whose book, "Witness to a Crime", is now published and available to purchase (regarding how the Presidential election was stolen in Ohio in 2004; Richard was also twice a guest on VoteRescue Radio).

In our second hour we'll have an fascinating interview with Jim March, Black Box Voting Board member, accomplished election technology buff, and valiant Election Integrity activist.

Jim and Arizona EI activist John Brakey were involved in a December 2007 court challenge in Pima County, Arizona on behalf of the Pima County Democratic Party, against Pima County election officials for the release of the Diebold (GEMS tabulator) databases containing voting data from the 2006 election (and those from all future elections), on the presumption that they should be public records. There is a belief that these databases could show fraud or other malfeasance by county election officials. The county maintained, of course, that releasing such information would make tampering in future elections easier, even though those same county officials and insiders have all the means and opportunity to manipulate elections.

We'll also talk with Jim about his arrest in July of 2005 for trying to observe the Diebold central tabulator as the votes were being counted in San Diego's mayoral election.

Other news we'll cover will include the April 18th non-hearing at the Ballot Law Commission in New Hampshire for Albert Howard's Petition for Appeal of the recent New Hampshire primary recount; the continued effort of evidence-gathering from that recount on the part of Bev Harris and citizen videographers and activists, and more information and analysis about the results of the Pennsylvania primary.
