AK-47 used to vandalize preserve

A 23-year-old Sycamore Township man was so angry the Grand Valley Preserve in Indian Hill revoked his park privileges for setting fires to keep warm while fishing – despite being warned against it– he destroyed the gate of the preserve with an assault rifle and ax, according to village police.

“This is not normal behavior,” said Indian Hill Det. Steve Makin. “It concerns me, but doesn’t surprise me.”

Michael Rosenbaum was arrested Tuesday on charges of vandalism and possession of criminal tools for the Nov. 24 park destruction.

Rosenbaum’s cousin, Christopher Trammel, who Makin said knew what Rosenbaum was going to do, but drove him to the preserve anyway, was also arrested.

Trammel, 23, of St. Bernard, is facing a charge of complicity to vandalism.

Makin said Rosenbaum frequented the nature preserve and last month was warned to stop setting fires which he was doing to keep warm while fishing. When Rosenbaum was caught setting another fire, the park revoked his pass.

“He was angry,” Makin said.

Rosenbaum is accused of buying an AK-47, arming himself with an ax and then heading to preserve on State Route 126 at about 8 p.m. Nov. 24.

Once there, Makin said, Rosenbaum used the ax to destroy the card reader and wooden gate at the preserve’s entrance. Then he fired four rounds into the metal box that controls the gate, Makin said.

Damage is estimated at $1,500.

Rosenbaum is being held in the Hamilton County jail without bond. He has a prior trafficking in drugs arrest, but was going through a drug court program which meant that if he successfully completed treatment that charge would be dismissed.

The park arrest was a violation of that program, resulting in his being held without bond.

Trammel was released from jail with a promise to return to court.

One of the citizens said they will protest. As of this time, Oct. 31, 2009 12:18 a.m., I cannot locate any text on WKCR nor other media outlets. I feel confident that right wing media will outdo themselves over the days to come. I 'd wager the Cincinnati Enquirer won't be able to control themselves.

THE FOLLOWING REGULATIONS ARE REQUIRED OF ALL ENTRIES:



If the word “Christmas” is used in your float, it must be spelled out. (No abbreviation, i.e. XMAS).
Each entry MUST be decorated in a “holiday” theme.
Each entry will be required to provide a description of the entry, on the entry application. No entries which are offensive to the public will be permitted.
The Parade Committee reserves, in its sole discretion, the right to prohibit or remove disruptive or dangerous entries or persons from the parade at any time (even if the entry was previously permitted).
“Santa Claus” is not permitted as part of any entry except the Holiday Parade Committee’s entry.
THROWING OF OBJECTS (i.e. candy) is strictly prohibited. Walkers may hand out candy and gifts alongside the entry. Please make note on the entry application if walkers will be passing out anything.
There must be 3 car lengths between each entry at all times.
Each entry will be assigned an entry number. These numbers determine line up area and placement. This number must be displayed and prominently visible on the right side of entry for judging purposes.
Children who are participating in the parade entry and are being “dropped off” at the loading spot, MUST be met by a representative of their entry. The parade committee DOES NOT accept any responsibility in getting the children to the appropriate entry.
All parade entries MUST have a contact person with their entry. That contact person MUST be present with the entry the day of the parade.
All contact persons will be responsible to ensure that liability waivers are signed by all participants (or parent/legal guardian) on the entry and turned into the committee.
All vehicles, motorized and non-motorized MUST obey all traffic laws.
Vehicles, motorized and non-motorized WILL NOT “circle” while in the parade route.
Police officers on duty will remove anyone operating any vehicle in a manner that is deemed unsafe or that could risk harm to spectators and/or participants.
The parade will end either in the Kroger’s parking lot or Wal-mart parking lot. Keep in mind that we are guests on their properties. Please do not linger after arriving there and depart as soon as possible, as a courtesy to their customers. These lots are very congested and busy, please keep close tabs on the children in with entry.
Award winners will be notified by phone. The dates, time and location of the awards ceremony will determined at a later time.

On Wednesday, October 14, 2009 at noon, Moveon.org and some health professionals met with personnel in Sherrod Brown's Cincinnati office to show support for the Senator in committing to the Public Option but - he wasn't there. When Moveon.org left the office they were treated to a scene of an extensively tea-baggered Fountain Square, opposing the "Public Option."

So now, in the light of this article, I think it's entirely possible that I might be correct in my perception that Senator Brown and the Cincinnati Tea Party adherents are perhaps close to a bipartisan compromise.

How nice for them. Count me out.

I saw the story about the Butler County budget in the Cincinnati Enquirer.
I saw the story about Section 8 housing coming to Butler County on the web site of WCPO. These 2 stories are so very interesting when read together.
REPUBLICANS AND TEA - BAGGERS SHOULD BE ENTITLED TO WELFARE - NOT JUST US DEMOCRATIC AND GREEN SLACKERS! (EVEN THOUGH IN OUR FANTASIES WE TRY TO IMAGINE REPUBLICANS AND TEA -BAGGERS HAVING TO CHOOSE BETWEEN TAKING THE METRO OR NOT GETTING TO WORK. I've plenty of other daydreams with humiliation themes.

Butler budget group: List essentials

The latest suggestion from a new Butler County budget group involves creating a list to separate the essential and non-essential services the county provides.

Butler County Auditor Roger Reynolds, a member of the group, said the distinction is needed to understand what the county has to provide and what should be eliminated as department heads brace for more cuts. He asked commissioners to consider the idea during their Thursday morning meeting.

"It goes back to needs and wants," Commission President Don Dixon, also a member of the budget committee, said.

The board did not take any action on the recommendation. Instead, they put it under review much the same way they did earlier suggestions made by the group of elected officials and financial experts looking to help solve the county's budget woes.

Earlier ideas include forming a separate fund for debt payments, creating a draft budget and asking commissioners to put updates about the group's progress on the county's Web site.

The group formed this summer after a round of mid-year budget cuts, dozens of layoffs and other reductions.

In all, county officials trimmed more than $8 million and borrowed $5 million from cash reserves to balance this year's $91 million general fund budget.

The county finance team is still crunching numbers, but if revenue continues to drop, another $4 million to $9 million will need to be trimmed next year.

It is unclear what cuts will be made and how those will impact services.

Saturday,October 3 will be the date for anyone wishing to get on the waiting list for Butler Metropolitan Section 8 housing.

It's been five years since the waiting list was last opened back in 2004. Over 2,300 applications by low income residents were received in a six hour period back then. It's taken The Housing Authority 5 years to get all but 70 of those 2,300 persons placed with vouchers for housing.

Butler Metropolitan Housing has almost 1,000 persons currently using vouchers for housing. Barbara Brown Section 8 Manager says, "because of the economy the way it is, we expect a lot of new people that have never had assistance before."

Brown estimates as many as 5,000 people may file pre-applications on Saturday.

Besides the Section 8 housing applications, other agencies dealing with low-income based programs such as food stamps, energy assistance, and Legal Aide will be there to tell people about those services.

The application for housing vouchers will be at the New Life Vineyard Church, on Princeton Road in Hamilton. The event will run from 9 a.m. to 4 p.m. on Saturday, Oct. 3. The agency will hand out numbers on a first come first served basis.

The United States Postal Service has narrowed the number of offices facing possible closure from over 700 down to 413. But, seven of those smaller post offices still on the list are in Cincinnati and Hamilton.

The post office is struggling with a sharp decline in mail volume caused by the recession and the movement of traditional mail to the Internet. Postal officials say the agency could have a deficit as large as $7 billion this year.

Being on the list doesn't guarantee closing, but those post offices will be re-evaluated to see if it's cost effective to keep them open.

Currently, the post office has about 37,000 retail outlets across the country and Postmaster General John Potter has said he wants to keep as many open as possible.

The post offices in the Tri-State that remain on the at-risk list include: Cummingsville, the East End, Newtown, Reed Hartman Finance, Sayler Park, the Stock Yards branch, and Lindenwald in Hamilton.

I grew tired of waiting for my Food Stamp Ohio Direction Card.

Prior to calling the number below today, September 1, 2009, I received mailed information from Ohio Department of Job and Family Services saying that I would receive the card. The only thing that was emphasized was the requirement to call in to activate the card and get a PIN #.

I called 1 - 866 - 386 - 3071 from the Ohio Department of Job and Family Services mail I received.

I spoke with a Customer Service Representative named Olivia in Utah.

Olivia told me that the only way to physically obtain the Ohio Direction Card is to call and request it.

She said to expect it to between 5 - 7 days.

Hannity concert closed to most media

Tickets are pretty much sold out for the Sean Hannity Freedom Concert at Kings Island tonight.

At 2 p.m., less than 100 seats -- all with obstructed views -- were left at the 10,000-seat Timberwolf Amphitheatre, said Kings Island spokesman Don Helbig.

The concert lineup includes Billy Ray Cyrus, Charlie Daniels, Lee Greenwood and Michael W. Smith performing at 7 p.m.

Hannity himself, plus other political guests, also are expected to speak . However, most media outlets -- except Fox News -- have been excluded from covering the event by Hannity's organizers, Helbig said.

The sixth annual concert series benefits the Freedom Alliance Scholarship Fund started by Oliver North to help dependents of deceased or disabled U.S. military veterans. North will attend the show.

BELFRY, Ky. (AP) - Workers are pumping millions of gallons of water out of a mine in Pike County after it was shut down for safety reasons.

Federal officials ordered the Freedom Energy Mine at Sidney Coal Company to close last week after a buildup of water in a sealed portion of the underground mine. Officials were worried about the seal failing and water flooding into a work area.

The mine is a subsidiary of Richmond, Va.-based Massey Energy. A Massey spokesman says 28 of the 162 miners employed at Freedom Energy have been inactivated. The rest were moved to other mines while the water is pumped out.

Spokesman Jeff Gillenwater said on Friday that the pumping will continue for another two weeks or more.

He says after that, the mine will be reopened and the inactive workers will return.

Hamilton County Commissioner David Pepper said this afternoon that the problem of homeless people sleeping on the plaza of the courthouse has grown noticeably worse and needs to come to an end.

“It’s clearly unacceptable for it to be used this way,” Pepper told The Enquirer. “The building needs to be clean and safe and perceived that way.”

In recent weeks, the population of people sleeping on the plaza’s 22 benches and in doorways and against walls has swelled to more than 30 a night, advocates for the homeless say. The numbers this year, even adjusted for the traditional summer increase, are higher than in recent memory.

Pepper plans to involve the Hamilton County Sheriff’s Department, Cincinnati Police and advocates to come up with possible solutions.

“In the big picture, it’s why we have shelters,” he said. “We should not turn a blind eye to the people in need, but we need to deal with it.”

The county facilities department cleans the plaza each weekday morning and would regardless of whether homeless people slept there. Discarded clothing, cardboard, newspapers, beverage containers and feces are deposited in a portable Dumpster. Benches and the plaza floor are cleaned with a disinfecting detergent and sprayed with a low-pressure hose, said facilities director Ralph Linne.

Streams of urine runs from the walls down the cracks of the sidewalk.

He said a group of homeless people live around the courthouse and the adjacent Hamilton County Justice Center.

“We clean because of normal usage every day,” Linne said. “A flock of pigeons can leave waste on the benches.”

Some homeless people like to sleep outside and avoid shelters, including the region’s largest, the Drop Inn Center in Over-the-Rhine.

"I think the positive is what he said about collaboration," said Josh Spring, director of the Greater Cincinnati Coalition for the Homeless, when told of Pepper's comments. "We're on board. We'd much rather have collaboration than confrontation. Hopefully we can come up with some lasting solutions.

“You have different personalities in homeless people, here and nationwide,” Spring said. “For some the shelter setting works. For others, they only stay in a shelter in the winter when it’s almost obligatory. Then, in the summer, for some people, they prefer and feel better emotionally to camp out.”

The outdoor camping group tends to sleep under bridges, along the Ohio River bank in downtown Cincinnati or at the courthouse, where they feel an additional sense of safety.

Darren Hardy, 44, an unemployed homeless man who slept on one of the plaza’s 22 benches overnight Monday, said the benches fill up fast and that other people are sleeping on flattened cardboard boxes, carpet remnants and newspapers spread out on the concrete surface.

“The police don’t mess with you up here; you hear them drive past,” said Hardy, who used his duffle bag for a pillow and loaned his jacket to a woman sleeping on the bench across from him.

The Drop Inn Center is averaging 250 people overnight this summer, compared to 200 a night last summer, said director Pat Clifford. If the center runs out of beds, it spreads sleeping mats on the floor.

“No one is turned away,” Clifford said.

The county will look into “good-cop and bad-cop” solutions, Pepper said.

“The line `we’re here because no one says we can’t be’ is not acceptable,” he said.

I'm worried about the Civil Rights Obligations of Recovery Act Grantors and Applicants within the context of The American Recovery and Reinvestment Act of 2009.

I won't have much confidence in future elections that address efforts to improve the delivery of medical care as well as issues related to The Americans With Disabilities Act of 1990 if Alex Triantafilou is permitted to continue serving as the Chairman of the Hamilton County Ohio BOE.

The Specter of Arlen sets off a Cincinnati political tiff

The defection of Pennsylvania Sen. Arlen Specter to the Democratic Party has Republicans nationwide fuming and declaring "good riddance;" few more so than Hamilton County Republican Party chairman Alex Triantafilou, who raged over the Specter defenction on his blog Wednesday.

It was not so much the words Triantafilou used than the pictures that accompanied them which set off Hamilton County Democratic Party chairman Tim Burke.

What Triantafilou did that set Burke off was pairing an old picture of Specter when he was bald from his chemotherapy with a picture of the hairless Dr. Evil from the Austin Powers movies. Specter's hair, by the way, has grown back.

Burke fired off a release headlined: "Republican Party Ridicules Cancer Patient."

"It is just that kind of insensitivity to the plight of real people that is causing the Republican Party to lose so many of its previous followers," Burke wrote, noting the photo was taken during Specter's chemotherapy.

Late Wednesday afternoon, Triantafilou said he meant no harm and pooh-poohed Burke's complaint.

"Tim needs to lighten up,'' Triantafilou said. "It was funny. Dr. Evil is a character in my favorite movie. I meant no disrespect to Sen. Specter."

Triantafilou said the photo of Specter he used was the first one that popped up when he did a Google photo search.

UPDATE: Wednesday night, Triantafilou took down the photos on his blog and replaced them with the word CENSORED.

YET ANOTHER UPDATE: The "CENSORED" thing came off of Triantafilou's blog last night, replaced by a photo of a grumpy child. Then, Thursday, the whole post on Specter, photos and text, disappeared from the blog. The whole thing, Triantafilou said, "was becoming a distraction."

Your message regarding comments made by Alex Triantafilou in a weblog for the Hamilton County Republican Party was referred to my attention. As you are aware, Mr. Triantafilou currently serves as chair of the Hamilton County Republican Party and chair of the Hamilton County Board of Elections. In your message, you asked Secretary of State Brunner to consider replacing Mr. Triantafilou as chair of the Hamilton County Board of Elections.

The Secretary of State possesses the authority under state law to remove or suspend members and employees of the boards of elections. Such removal may be effected "for neglect of duty, malfeasance,misfeasance, or nonfeasance in office, for any willful violation of Title XXXV of the Revised Code, or for any any other good and sufficient cause." R.C. 3501.16. At this time, there does not appear to be a level of factual evidence that would provide the legal justification for removal of Mr. Triantafilou from the Hamilton County Board of Elections.

It seems clear that the weblog upon which Mr. Triantafilou made the comments at issue is sponsored by the Hamilton County Republican Party. Mr. Triantafilou's comments on this weblog appear to be made in his role as chair of that political organization. Absent any evidence that these comments were posted on board of elections time or using board of elections resources, this activity does not appear to violate state election law.

Moreover, members and employees of the boards of elections retain their rights under the Ohio Constitution and United States Constitution to express political opinions. Political speech is a core value protected under Article I, Section 11 of the Ohio Constitution and the First Amendment to the United States Constitution. "The hallmark of the protection of free speech is to allow 'free trade in ideas' - even ideas that the overwhelming majority of people might find distasteful or discomforting." Virginia v.Black, 538 U.S. 343, 358 (2003). Although someone may feel Mr. Triantafilou's comments on a political party web site were hurtful, objectionable, or repugnant, they are likely protected as an exercise of his fundamental right to free speech.
TEA PARTIES:

These might offer opportunities for fund-raising, the Lobby Industry and campaign funding events that seek and attract people across the political spectrum save for the Democrats. Why are suburban Republicans and a variety of other political parties from nearby counties appearing at Cincinnati Tea parties? Former Republican Senator to our U.S. Congress, Steve Chabot spoke at the first Tea Party downtown. Steve Chabot (R) lost his position as a Senator from Ohio in the U.S. Congress in November 2008. Very shortly after the loss, he announced that he's running again. Cincinnati, Ohio elected President Obama and Vice - President Joe Biden. Some areas of Hamilton County favored John McCain and Sarah Palin.

I think that alert progressive financial watchdogs should consider honing their skills to legally pursue the possibility of eliminating the Lobby Industry. I think Americans would be the better for it.

Licking County will have to pay for more than $400,000 in traffic fines that were misdirected into county coffers from 2004 to 2008.

Licking County Municipal Court Clerk Marcia Phelps says the money was erroneously forwarded to the county instead of the State Highway Patrol, the city of Newark and the local law library, which were supposed to receive the funds after a 2004 change in state law.

A programming error that went undiscovered until after Phelps took office in 2008 is responsible for the misdirection, Phelps said. Under the law, half the fines received from drivers convicted of drunken driving or driving with suspended licenses goes to the patrol. The county gets 10 percent.

Since 2004, however, the clerk's office had been depositing the money into the budgets for the county sheriff and engineer.

Commissioner Tim Bubb said that because the money was misdirected over several years, it may take just as long to pay it back. He said it was not appropriate for the money to be paid out of the county's general fund.

The commissioners recently cut $3 million from the county's budget in response to lower-than-expected sales tax revenue.

"The immediate impact is maybe a road doesn't get paved that would have," Bubb said. He acknowledged, however, while the money was being misdirected, more paving work was done than would have been otherwise possible.

Phelps said the commissioners already have paid $32,713 in misdirected funds for 10 months of 2008, which was caught late last year.

Butler County owes IRS $500K

Butler County may have to pay $500,000 in back taxes for not reporting the use of county-issued cell phones, uniforms and cars as employee benefits.

The Internal Revenue Service has been reviewing county books from 2005 to 2007. They found, according to county officials, approximately $1.5 million in benefits that should have been reflected on employee taxes. The IRS has asked Butler County to pay a third of that amount.

Calling the policy "unfair" and a "money grabber," Commissioner Greg Jolivette said it didn't make sense to take away money from a county in need at a time when the federal government plans to spend billions to create jobs.

"I think it's wrong to go after the taxpayers, especially at a time when everybody's budget is so critical. Our budget is critical. We're laying off people," he said. "They say they want to create and retain jobs, and then they're going to turn around and take this from us?"

The audit's findings are wrapping up just weeks after the county closed a $7 million revenue shortfall, a result of drops in sales tax and other market-based returns. More than 60 people have been laid off since last year.

"Obviously, this couldn't have come at a worse time," said Commission President Don Dixon.

"But we'll have to deal with it because in reality, we should have had a plan in place. We shouldn't be here. ..."

Because of the audit, Dixon said officials are working to a adopt clear, countywide policy on the use of cell phones and other benefits.

Jolivette sent letters to several in Congress, urging them to give the county an exemption on the policy.

If that doesn't happen, Dixon said the county will be forced to pay the back taxes with money from its carryover fund.

Council committee to review funding system

After some Cincinnati social service agencies that had gotten money for years learned they will get nothing from the city this year, City Council members said they have to figure out what went wrong with the system they put in place.

"It did not work the way it was intended to work," Councilwoman Leslie Ghiz said Friday, referring to the plan council approved unanimously last June.

The system was supposed to make funding decisions more fair and target the city's approximately $2 million to fewer agencies to make a bigger impact, said Councilman Chris Bortz, who pushed for the changes with Vice Mayor David Crowley.

Bortz said it should have been clear that fewer agencies would get money.

Council members will talk about the issue Tuesday at 11 a.m. in a special meeting of the Finance Committee called Friday by Chairwoman Laketa Cole.

"It was clearly council's intention to receive recommendations on the funding, and then take action," she said in a statement. "So far, it looks like we've been cut out of the process."

She decided to have the hearing, the statement said, after being told several agencies that have been funded for years saw their money cut with less than a week's notice.

Among the agencies cut: the YWCA Battered Women's Shelter, FreestoreFoodbank, Bethany House Services and Society of St. Vincent DePaul.

All the agencies that were cut had their funding extended from the end of last year through the end of March.

Charlene Ventura, executive director of the women's shelter, said Thursday she knew the system had been changed, but didn't expect to lose the $141,000 the agency got last year. The shelter has been funded by the city since 1982.
I'm a special education teacher and I am not laughing. Two incidents in just a few days is a bit much.

Special Olympics?

Maybe he has spent too much time in the basketball locker room, where tough guys laughing at less-tough guys is part of the whole deal.

It is not a sign of moral turpitude, for goodness' sake, but (remember the Nancy Reagan joke in his first news conference?) it is something he has to address. I wonder if Michelle might be telling him that right now.

This is a wise piece on an unexpected problem...

HERE'S THE RESPONSE THAT I POSTED:

I'm a registered Democrat with Green Party tendencies who likes, as well as voted for President Obama. I'm a special education teacher. From the beginning I have communicated my displeasure to him at change.gov as well as change.org about permitting charter schools and their private corporations to invade the well-being of our once -upon - a - time public school system, as well as his devotion to the proficiency testing madness of the last 8 years. Now, I need to communicate 2 additional concerns. Although his teacher pay - by - performance incentive ideas continue to entrap teacher unions who have gotten used to regularly being defanged by the last 3 Republican Presidential Administrations, President Obama at some level must know that a happy and properly unionized teacher makes for educated and productive students. The other concern I have is that President Obama may continue the former administrations' policies of increasing the deregulation of Special Education Laws. The turning point occurred years ago when Public Law 94-142, The Education for All Handicapped Children Act was domesticated by deregulating it and repackaging it as IDEA, or the Individuals With Disabilities Education Act. President Obama's bowling comment slip should be forgiven as long as he steps up to the plate with Education Secretary Arne Duncan and meets our demands for the reinstatement of Public Law 94-142, The Education for All Handicapped Children Act.

I gave some thought to the article that I copied from the Cincinnati Enquirer. I believe that our history of how American individuals chose to die, choosing to boycott the goods and services of King George III and die some more - prevailed by creating the Constitution. More Americans died - African Americans died when they boycotted the buses under Governor Seth Gordon Persons. And throughout all this, Native American Peoples died defending themselves yet survived. They bear scars individually and group scars.We are all part of eachother.

I suddenly realized today that the original participants in the Boston Tea Party didn't just don neutral camouflage before boarding the ships. Some assumed the garb of Native Americans as well as applying makeup. One could interpret this as trying to put the blame on the Native Americans as well as African Americans. Here's a description that I found from "The Boston Tea Party Gazette," an online resource covering the Revolutionary War:

Montague's words were an omen for the patriots.

We've got "The Dartmouth" and "The Eleanor." Why on earth did the third historic ship end up with a name like the "The Beaver?" How fortunate we were that the smallpox quarantine on "The Beaver" was lifted just in time!
And speaking of overtly silly things with ominously historical undertones...

A group calling itself Cincinnati Tea Party is holding a rally to protest the economic stimulus package and the foreclosure bailout on Fountain Square Sunday, March 15.

The group, which calls itself a "grassroots citizens movement in favor of fiscal responsibility, free markets, snfd limited government" is advertising its event on the website of COAST (Coalition Opposed to Additional Spending and Taxes) and on its own website, www.cincinnatiteaparty.org.

The organizers are taking their inspiration from the Boston Tea Party of 1773, when the Sons of Liberty boarded three ships in Boston Harbor in the dead of night and dumped great loads of British tea into the water, as a protest against British taxes on tea. On the Cincinnati Tea Party website, organizers are asking rally-goers to bring three things - "signs, tea bags and more people." The tea bags, they say, will be dumped into barrels to re-enact the 1773 protest.

The rally begins on Fountain Square at 3 p.m. Sunday, March 15 and the main speaker will be former Republican congressman Steve Chabot, who was voted out of office in last fall's Democratic landslide. Chabot has already said he will run in 2010 against Steve Driehaus, the Price Hill Democrat who bounced him out of office last fall and who voted for the economic stimulus package last month.
